Judge Rules in Favor of Dispensary in Centennial Case!
A big congratulations and thanks to the attorneys, witnesses and CannaMart dispensary on the recent Centennial court ruling!
Thanks for standing up to the city of Centennial and their unlawful actions to shut-down the CannaMart dispensary and deny access to medical marijuana patients that need meds.
This could be a landmark case that eventually gets puts into case law. It is through people making a stand like this, that positive change will continue to take place. We have come a long way and today is testament to this.
The Judge in the Centennial case, District Judge Christopher Cross, said "The city of Centennial cannot use the potential violation of a federal law to order a business legally operating under our state constitution to cease and desist its business." It was also refreshing that he stated that the city's actions voilated the owners' and patients' constitutional rights which he called "an irreparable injury to all of us."
This ruling could have an impact on other Colorado municapilities and future cases. Judge Cross also stated "A city cannot ban this type of use, It can zone it, but it can't ban it." I am sure many dispensaries and lawyers are paying attention and this could be a common theme in future litigation.
